Ratnagiri Nagar Parishad filed a suit in 2005 for a permanent injunction against a Solid Waste Disposal Project. The High Court and lower courts granted relief in favour of the plaintiffs. On appeal, the Supreme Court held that following the establishment of the National Green Tribunal Act, 2010, the civil courts lacked jurisdiction to entertain such environmental disputes. The Court set aside the earlier judgments and decrees as nullity, but clarified that affected parties could still seek statutory remedies through representations to environmental authorities and appeals before the NGT or other lawful forums.
