In Brief
The landlord sought eviction of tenants from premises originally let for a saw mill, claiming the tenants had changed its use to manufacturing grills in breach of the lease. The Supreme Court dismissed the appeal, holding that absent an express negative covenant in the lease deed restricting use to only the saw mill, the tenant's liberty to carry on other business was implicit. Since the lease permitted any business activity, switching from saw mill to grill manufacturing did not constitute unlawful change of user. Courts below correctly rejected the eviction petition.
