Landowners acquired small parcels for an Express Highway project challenged the High Court's market value determination of ₹62,11,700 per acre. The Supreme Court held that courts must evaluate all evidence—particularly comparable sales—rather than rely solely on government floor rates. Where smaller land holdings in urbanized areas are acquired, comparable sale exemplars for similar smaller extents may be appropriately used. The Court determined market value at ₹25,20,000 per acre after applying a 25% development cost deduction (justified by substantial highway infrastructure needs). Regarding excess compensation previously paid, recovery is permissible in three interest-free half-yearly instalments. Appeals partly allowed.
