The appeal concerned an inter-regional transfer of an employee from Maharashtra to Orissa. Although the employee held the rank of Upper Division Clerk at the time of transfer, the transfer was wrongly effected in the designation of Lower Division Clerk. The Court found this transfer legally impermissible. Since another employee had already filled the available UDC vacancy, the transferred employee was granted only notional benefits (seniority and pay restoration) in the UDC post from the transfer date, with actual monetary benefits accruing only from the date of actual promotion to UDC in 2011.
