Remya P. and Ors vs K.M. Abraham (Dr.)

Bench: 2 — <UNKNOWN>

In Brief

Four natural guardians of minor Endosulfan victims sought enforcement of a Supreme Court order from 10 January 2017 directing payment of Rs 5 lakhs compensation to each affected individual. The Government of Kerala had withheld payment, classifying these four victims in an 'Other' category deemed ineligible under the expert medical panel's categorization. The Court held that despite this administrative classification, the individuals were clearly affected persons undergoing treatment and entitled to the Court-ordered compensation. The Court rejected the Government's justification for non-payment and directed release of compensation within two months, disposing of the contempt proceedings with liberty to revive if non-compliance continued.
