The appellants challenged a judgment permitting the sale of joint family property, arguing that the sale deed executed in 1983 to discharge a mortgage debt incurred in 1981 was improper and that they had severed the joint family status. The Supreme Court held that a sale deed executed to discharge a mortgage debt incurred for joint family purposes constitutes a valid exercise of legal necessity by the joint family head, provided a direct nexus exists between the debt and the sale. The Court rejected the claim of severance, finding that no clear and unequivocal declaration of separation had been established. The appeal was accordingly dismissed."
