Rhea Chakraborty vs State of Bihar & Ors

Bench: 1 — Hrishikesh Roy

In Brief

The Supreme Court disposed of a transfer petition filed by Rhea Chakraborty seeking to transfer an FIR registered in Patna to Mumbai, regarding the death of actor Sushant Singh Rajput. The Court held that while Section 406 CrPC does not permit transfer of investigations between police stations, it invoked its plenary power under Article 142 to ensure impartial investigation given serious allegations of political interference by both states. Approving the ongoing CBI investigation initiated by Bihar, the Court directed that if any new FIR is registered in Mumbai on the same death and circumstances, the CBI must investigate that case as well to maintain unified, credible investigation and public confidence."
