Supreme Court of India 2017-09-19 remanded

Richa Dalmia and Anr vs State of Jharkhand and Anr

Bench: 2 — Ranjan Gogoi

In Brief

Richa Dalmia and another sought to quash criminal proceedings filed against them in Dhanbad by petitioning the High Court under Section 482 Cr.P.C., raising both jurisdictional objections and merit-based challenges to the maintainability of the case. The High Court upheld Dhanbad Court's jurisdiction but did not address the merit-based contentions. The Supreme Court confirmed that Dhanbad Court possessed territorial jurisdiction, but found that the merit-based issues had not been considered. Accordingly, the Court remitted the matter to the High Court for complete adjudication of the merit-based objections to maintainability, with an interim protection extended for four weeks.
