Rizwan Khan vs State of Chhattisgarh

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

Rizwan Khan appealed against his conviction under the Narcotic Drugs and Psychotropic Substances Act for possession of psychotropic substances recovered from a vehicle. The Supreme Court upheld the conviction, holding that the prosecution had complied with statutory procedures and established recovery of contraband from the accused. The Court rejected the argument that ownership of the vehicle must be proved, stating that what matters is the recovery of the contraband itself. The Court also affirmed that police evidence is admissible when procedures are followed and need not be corroborated by independent evidence. The appeal was dismissed.
