Rofiqul Hoque, declared a foreigner by a Foreigners Tribunal in 2017 based on inconsistencies in voter list evidence, challenged the order before the Supreme Court after his name appeared in the draft National Register of Citizens (NRC) in 2018. The Court upheld the Tribunal and High Court findings that Hoque failed to prove he was not a foreigner under section 9 of the Foreigners Act, 1946. The Court held that inclusion in the draft NRC does not annul a Tribunal's declaration of foreign status, and that the competent authority under NRC Rules refers to the Foreigners Tribunal. The appeal was dismissed, and Hoque was declared a foreigner.
