Two appellants challenged their conviction for assault and criminal intimidation under IPC Sections 307, 323, 325, and 506 in relation to the death of a person. The Supreme Court upheld the conviction, holding that even though the charge was initially framed under Section 149 (liability for acts of unlawful assembly), it could be converted to individual liability when the number of accused fell below five during trial. Since the evidence showed injuries were inflicted by multiple weapons, no single appellant could be held responsible for causing death, but each was guilty of causing grievous injury. The Court found no reason for leniency and dismissed the appeals.
