In Brief
The Supreme Court set aside a High Court order that had allowed a writ petition seeking restoration of possession of a flat. The Court held that disputes about property possession between private individuals are not maintainable under Article 226 (writ jurisdiction) when civil remedies such as ordinary suits are available. The High Court had impermissibly entertained the petition and recorded factual findings on ownership and possession, essentially converting the writ petition into a civil suit. The Court directed that such disputes must be adjudicated in a properly constituted civil court, and granted liberty to the parties to pursue civil proceedings for their claims.
