In Brief
Royal Western India Turf Club argued that casual workers employed on race-days were not covered under the Employees State Insurance Act and should not pay contributions. The Supreme Court held that casual workers engaged for any part of a wage period on perennial activities are employees under the Act. The statutory notification of 18 September 1978 extending the Act to the Turf Club had binding force and could not be overridden by earlier consent terms. The Court held the Turf Club liable to pay contributions from 1978-79 onwards with statutory interest. The appeals by ESI Corporation were allowed and the Turf Club's appeals were dismissed.
