Rupinder Singh Sandhu vs State of Punjab & Others

Bench: 2 — Chelameswar

In Brief

Rupinder Singh Sandhu and Navjot Singh Sidhu were convicted of causing death under Section 304 IPC following a road-rage incident in 1988 that resulted in Gurnam Singh's death. The Supreme Court reversed both convictions. While finding that the first accused inflicted a single fist blow on the deceased, the Court held that medical evidence was insufficient to establish the blow caused death—the pathologist found no brain pathology, and the subdural hemorrhage was not described in detail. For the second accused, his identity was never properly established; witnesses identified him 5-7 years later without prior knowledge of him. The Court convicted the first accused only of voluntarily causing hurt under Section 323 IPC, imposing a fine of Rs 1000.
