Colonel S.K. Jain, Commandant of a military vehicle depot, was court-martialed for corruption, unlawful ammunition possession, and unexplained cash. The Court Martial convicted and dismissed him. The Tribunal acquitted him of corruption, found the ammunition (old and harmless) did not violate the Arms Act, but held he breached military discipline by failing to properly dispose of ammunition. It substituted his conviction under Army Act Section 63 and reduced his punishment to compulsory retirement with benefits. The Supreme Court upheld this, holding the Tribunal validly exercised its power to substitute convictions under related offences where the evidence justified it, and the mitigated punishment was proportionate and just.
