Saeeda Khatoon Arshi vs State of UP & Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The appellant lodged an FIR alleging that her daughter had hanged herself on information received from her son-in-law. The Additional Sessions Judge (Fast Track Court) issued summons against the son-in-law under Section 319 CrPC based on the allegations. The High Court set aside this order under Section 482 CrPC with minimal reasoning. The Supreme Court held that the High Court erred by failing to substantively analyse the basis for the lower court's order and cannot summarily displace it with brief observations. The Court upheld the Additional Sessions Judge's order and allowed the appeal.
