SAGAR BEHERA @ BANAMALI @ DAYANIDHI vs STATE OF WEST BENGAL

Bench: 2 — D.Y. Chandrachud, Sanjiv Khanna

In Brief

The appellant, convicted in 2004 for murder, robbery, and related offences under IPC sections 302, 394, 323, 34, and 411, was sentenced to life imprisonment. He later raised a plea of juvenility, claiming he was a minor when the offence occurred in April 2001. The Supreme Court ordered verification of his date of birth from original school records. Finding him to be 17 years old at the time of the offence and hence not a juvenile, the Court rejected the plea. However, recognizing his 20+ years of incarceration and good conduct in prison, the Court suspended his sentence and directed the State to decide on remission within two months."
