A public limited company (Sahakar Global Limited) was disqualified from a toll collection tender because it submitted a notarized power of attorney instead of a registered one. The Supreme Court held that the NIEB (Notice Inviting Electronic Bids) did not explicitly mandate registered power of attorney for public companies—only for partnership firms and private limited companies. Since the NIEB permitted the tendering authority to seek clarifications and additional documents, it should have requested the registered document rather than rejecting the bid outright. The Court set aside the High Court's dismissal, cancelled the contract awarded to the lowest bidder, and directed it be awarded to the appellant based on its superior financial offer (after verification by the State).
