Sai Babu vs Clariya Steels Pvt. Ltd

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

In this appeal, the Supreme Court clarified the scope of arbitral proceedings termination under the Arbitration and Conciliation Act, 1996. A sole arbitrator had terminated proceedings under Section 32(2)(c) and later purported to recall that order. The Court held that no recall application lies once an arbitrator's mandate has terminated under Section 32, distinguishing this from situations under Section 25(a). The Court set aside the High Court's judgment and appointed a substitute arbitrator by consent of both parties to continue the proceedings.
