Sai Wardha Power Generation Limited vs Tata Power Company Limited Distribution & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Sai Wardha Power Generation and Hindustan Petroleum challenged Tata Power Company Limited-Distribution's levy of wheeling charges on power supplied through transmission lines. The Supreme Court held that these lines were included in TPC-Transmission's transmission licence and could not be treated as part of TPC-Distribution's distribution system without formal licence amendment. The Court set aside the tribunal's judgment and remanded the matter, directing that TPC-Transmission's pending application for licence modification must first be decided by the regulator within two months, followed by tribunal adjudication within three months, before the wheeling charges dispute could be finally resolved.
