A developer was granted temporary injunction by the High Court against sellers of a large tract of land (36 acres 21½ guntas), after it had sold plots to third parties and sought to register an agreement for the remaining 17 acres 31½ guntas. The sellers cancelled the agreement, claiming non-payment of consideration. The High Court vacated the temporary injunction restraining interference with possession but maintained another injunction preventing the sellers from alienating or creating third-party rights. The Supreme Court upheld the High Court's order, finding that the developer's interests were adequately protected pending trial and dismissed the appeal."
