A candidate (Salam Samarjeet Singh) who qualified in the written examination for District Judge (Entry Level) recruitment by the Manipur High Court challenged his failure in the subsequent viva voce interview. The High Court's Full Court had prescribed a 40% minimum passing mark for the viva voce on 12 January 2015, shortly before conducting the candidate's interview on 12 February 2015, without informing him beforehand. The candidate scored 37.6% and was declared unsuccessful. A two-judge Bench split: one judge held the mid-process change in rules impermissible and ordered the result quashed; the other upheld the High Court's action, ruling that being selected does not confer an indefeasible right to appointment. The matter was referred to a larger Bench for final decision.
