The Supreme Court dismissed an appeal challenging a High Court decision that allowed private claimants to acquire rights over land previously used as a Muslim burial ground. The Court held that the land was not validly declared a wakf property under Islamic law, as there was no express dedication and the burial use had ceased for over 60 years. The mandatory survey procedure required by the Wakf Act, 1954 had not been followed before issuing the declaration. The Court also found that the appellant Committee was estopped from challenging the High Court's 1965 direction to consider claims under the Land Abolition Act, having acquiesced to and participated in subsequent proceedings without objection.
