Samaj Parivartana Samudaya and Ors vs State of Karnataka & Ors

Bench: 3 — Ranjan Gogoi

In Brief

The Federation of Indian Minerals (FIMI South) sought permission to sell iron-ore and manganese ore in Karnataka through an alternative e-platform system rather than the Supreme Court-appointed Monitoring Committee. While the Central Empowered Committee and State of Karnataka agreed that the original objectives of the Monitoring Committee had been achieved, and recommended a new system with State oversight, the Court rejected the application. The Court held that given the history of egregious illegal mining and revenue leakage, and pending related matters concerning production caps and environmental restoration, the existing Court-supervised mechanism must continue until these connected issues are resolved.
