A real estate developer (appellant) was directed by the High Court to hand over eight flats and parking spaces to settle a dispute between other parties based on a settlement agreement to which the appellant was not a party. The Supreme Court held that the High Court exceeded its jurisdiction by granting a mandatory interlocutory injunction based on an agreement between respondents only. The Court established that a party can only be bound by agreements to which it is a signatory and that mandatory relief at an interlocutory stage must restore status quo, not impose new obligations from third-party settlements.
