Sangita Arya & Ors vs Oriental Insurance Co. Ltd. & Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

Sangita Arya and others filed an appeal against a High Court order that had reduced compensation in a motor accident claim. The Supreme Court found that the High Court's judgment was fundamentally flawed: it was based on the erroneous assumption that the deceased was a Government employee—something never alleged by the claimants. Relying on this false premise, the High Court had wrongly excluded income from running two taxis when calculating compensation. The Supreme Court set aside the High Court's order and allowed the appeal, directing the insurance company to pay the full compensation with interest within twelve weeks."
