Sanjay & Anr vs State of Uttar Pradesh

Bench: 2 — R. Banumathi

In Brief

Two brothers were convicted of murdering Roop Singh after firing bullets at him and his wife in 1998. Roop Singh survived 62 days after surgery and was discharged in stable condition before dying from septicaemia. The Supreme Court partly allowed the appeal, modifying convictions from murder (Section 302) to culpable homicide not amounting to murder (Section 304 Part I). The Court held that because the death occurred indirectly after considerable delay and the injured person was discharged in good health, the original injury cannot be presumed fatal in the ordinary course of nature. Convictions for other offences and sentences for common intention were affirmed."
