Sanjaybhai Chandulal Parekh challenged an FIR alleging dishonest misappropriation, cheating and criminal conspiracy relating to a land transaction. He was a second purchaser who bought the property in good faith from Accused No. 6. The High Court rejected his petition to quash the FIR. The Supreme Court held that when examining an FIR for quashing under Section 482 CrPC, the Court must verify whether basic essential ingredients of the offence are prima facie made out. Since the FIR contained no allegations of dishonest intention, knowledge of wrongdoing, or conspiracy against Parekh, the prosecution was an abuse of process. The Court quashed the FIR against him while preserving the right to investigate other accused persons."
