Two trusts of the same charitable institution disputed management rights. The respondents sued for an injunction, asserting the suit was not barred by law. When the trial court rejected the suit, the respondents appealed. During appeal, both parties agreed to arbitration, accepted the arbitrator's award, and obtained a final decree based on it. Later, when the appellants sought to enforce the decree, the respondents challenged the award's validity, claiming the dispute was non-arbitrable. The Supreme Court held the respondents were estopped by their conduct: having accepted and relied on the award to dispose of their appeal, they could not later deny its validity to escape obligations. The Court allowed the appellants to revive execution proceedings.
