Satyama Dubey & Ors vs Union of India & Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

A 19-year-old girl from Hathras, Uttar Pradesh was allegedly gang-raped and died following brutal assault; she was cremated at night without family presence. Multiple petitions and interventions sought CBI investigation, trial transfer to Delhi, and victim protection. The Supreme Court found that the Allahabad High Court was already seized of the matter and had registered a PIL. The Court held that the CBI's ongoing investigation, now directed by the state itself, addressed fair investigation concerns. The Court directed CRPF security for the victim's family and witnesses as a confidence-building measure, and kept trial transfer open for future consideration. All substantive matters were left for the High Court's ongoing PIL monitoring.
