A wife appealed against a divorce decree granted by the Family Court on grounds of mental cruelty, as upheld by the High Court. The Supreme Court found the marriage irretrievably broken down since both parties agreed to the divorce and the husband had remarried. While upholding the divorce, the Court set aside the maintenance award and, finding the husband had concealed multiple sources of income, awarded the wife Rs. 10 lakhs as one-time permanent alimony to be paid within three months, applying principles established in prior precedents on determining maintenance quantum.
