In Brief
A part-time Masalchi (menial worker) employed on a temporary basis for 2–3 hours daily sought regularization and back-dated salary benefits from completing ten years of service. The High Court had granted this relief. The Supreme Court held that part-time employees have no entitlement to regularization, as they do not work against sanctioned posts. A 2006 Government Order regularizing daily wage workers applied only to full-time employees completing ten years of service by 01.01.2006. Subsequent orders regularizing part-time workers granted benefits only from the date of the regularization order, not retrospectively. The Court set aside the High Court's decision, finding it legally unfounded and likely to burden the State exchequer enormously.
