The Supreme Court held that a plaint cannot be partially rejected under Order VII Rule 11 of the Code of Civil Procedure. Where a plaint discloses a cause of action against any defendant, the suit must proceed to trial against that defendant. The trial court erred in bifurcating the suit and striking out the pleadings against certain directors while allowing it to continue against the company. The Court set aside the judgment and granted the defendants eight weeks to file their written statement, after which the suit would proceed to trial.
