Senathi Na. Venkitasalapathi Ayyer and Sons Private Trust rep. through S.L. Sivaji, Recent Manager Trustee vs Indhumathi and another

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court held that the nature of a trust must be determined by examining its actual purpose, not merely its title. The appellant, styled as a 'private trust,' was found to exist for public benefit and therefore qualified as a public trust. As such, it was exempt from the Tamil Nadu Buildings (Lease and Rent Control) Act, 1960, and an eviction decree in its favour could be executed. The Court allowed the appeals, set aside the High Court's order, and granted respondent-tenants one year to vacate on condition of paying outstanding rent arrears and future rent within specified periods.
