The Supreme Court set aside a High Court order that had dismissed objections to an election petition challenging the election of the appellant from the Aravakurichi Assembly Constituency and had directed the petitioner to file additional documents (emails, photographs, video footage). The Court held that an election petition must contain a concise statement of material facts as required by Section 83(1)(a) of the RP Act 1951. The petition in this case contained only vague allegations of corrupt practice without pleading the nature or specifics of the alleged practice. The Court distinguished between material facts (which must be pleaded and are fatal if omitted) and material particulars (which may be supplied later). Since the appellant's term had already expired, the grounds of challenge were no longer relevant. The Court dismissed the election petition and held that directing the production of documents outside the pleading was improper when the petitioner had not sought permission to produce them.
