Shahid Khan vs State of Rajasthan

Bench: 2 — C. Nagappan

In Brief

Shahid Khan and co-appellants were convicted for murder and rioting under IPC Sections 148 and 302/149 based on eyewitness testimony from Mirza Majid Beg and Mohamed Shakir. The Supreme Court set aside the conviction, finding the eyewitnesses' credibility severely undermined by: unexplained 3-day delay in recording statements, unnatural conduct in not helping the injured or reporting to police, implausible claim of fear, and absence of corroboration from other witnesses present. The Court held the prosecution failed to prove its case beyond reasonable doubt and that the High Court miscarried justice by not re-evaluating the evidence.
