Shaikh Mustafa and Ors. Etc vs State of Maharashtra

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

This case concerns the conviction of six appellants for counterfeiting and circulating counterfeit currency notes in violation of the Indian Penal Code. The appellants were arrested after attempting to use counterfeit Rs 50 notes in local shops. The trial court and High Court upheld their convictions. The Supreme Court found no fault with the conviction but reduced the sentences from the original terms (ranging from 2 to 5 years) to the period already undergone (more than 18 months), recognizing that the appellants were mere carriers rather than masterminds and were poor daily wage earners. The appeal was partly allowed.
