In Brief
In this appeal concerning elections to the Dental Council of India, the Court examined whether a candidate whose name was omitted from Part A of the state register could contest the election. Although his eligibility appeared prima facie valid, the Court held that the High Court erred in interfering with the election after the election programme had been published. The Court reaffirmed settled law that courts should not disrupt election processes once commenced. Instead, post-election disputes should be referred to the Central Government under Section 5 of the Dentists Act. The appeal was allowed, the High Court's judgment was set aside, and the election result was directed to be published.
