Shalu Ojha vs Prashant Ojha

Bench: 2 — A.K. Sikri

In Brief

A wife sought enhancement of maintenance from Rs. 50,000 per month (set by the Additional Sessions Judge on appeal) back to Rs. 2,50,000 per month originally granted by a Metropolitan Magistrate under the Domestic Violence Act. The husband disputed the wife's claims of his financial capacity. The Supreme Court held that final maintenance determination requires full evidence and cross-examination by both parties regarding their financial claims. The Court remitted the matter to the trial court to complete proceedings within eight months and directed the High Court to urgently determine interim maintenance rates pending final adjudication.
