Shanti Devi alias Shanti Mishra vs Union of India & Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

Shanti Devi sought recovery of pension through a writ petition after an earlier petition for retiral benefits was dismissed on jurisdictional grounds. The Supreme Court held that territorial jurisdiction exists where the petitioner continuously received pension in a State Bank account within the High Court's jurisdiction. The dismissal of the earlier petition did not preclude filing a fresh petition with different subject matter. The Court allowed the appeal and directed payment of provisional pension pending final determination of the writ petition.
