This appeal involved a dispute over an alleged oral gift of property by one party (Sheikh Yakub) to another (Sakinabi). The trial court and High Court both found that the claimed donee failed to prove the oral gift, despite having been named as the recipient. She did not testify in her own favour, and the Sale Deed she later executed did not establish her title from the gift. The Record of Rights also did not support her claim. The Supreme Court upheld these concurrent findings and dismissed the appeal, holding that without direct evidence from the donee or corroborating proof, an oral gift cannot succeed.
