Shia Central Board of Waqf UP vs Sunni Central Board of Wakf

Bench: 5 — 5

In Brief

The Shia Central Board of Waqf Uttar Pradesh filed a Special Leave Petition seeking review of a 1946 judgment by the Civil Judge, Faizabad, but did so with an inordinate delay of nearly 68 years (24964 days). The Supreme Court dismissed the petition, finding that the extreme delay had not been adequately explained. The Court held that such unexplained delay is fatal to a Special Leave Petition and warrants dismissal without considering the merits of the case.
