Shilpa Shares and Securities & Ors vs National Co-Operative Bank Ltd & Ors

Bench: 2 — Kurian

In Brief

The Supreme Court set aside the High Court's order dismissing the appellants' writ petition seeking processing of their One-Time Settlement application with a bank. The High Court had rejected the petition solely because another writ petition filed by the Bank challenging an auction set-aside was pending. The Court held this reasoning was incorrect; a writ petition should not be rejected merely because related proceedings are pending. The appellant's petition should be reconsidered on merits by the High Court after the Bank's writ petition is disposed of. The Court directed the High Court to hear the petition afresh and requested expeditious disposal within six months.
