Shivang Mathur appealed against a High Court order that summarily dismissed a petition under Article 227 concerning amendment of a plaint. The trial court had partly allowed the amendment, but the High Court gave only a cryptic order dismissing the petition. The Supreme Court found that the High Court had not properly considered the merits or the parties' contentions on jurisdiction. With both parties agreeing, the Court set aside the High Court's order and remitted the matter for fresh consideration on merits with a reasoned judgment.
