Shyam Narayan Prasad appealed against a High Court judgment upholding a trial court's decision that an unregistered exchange deed was invalid. The case concerned ancestral property inherited from their common grandfather, Gopalji, which had been partitioned among his sons. The court held that property acquired by a son on partition retains the character of ancestral property as regards his male descendants, giving plaintiffs (the son's children) a right in the property. An unregistered exchange deed affecting immovable property valued over Rs. 100 is inadmissible in evidence and cannot be proved. The appellant also failed to plead part performance under Section 53-A of the Transfer of Property Act. The appeal was dismissed.
