In Brief
This case concerns whether a widow holding property with a restricted estate before the Hindu Succession Act, 1956 (Act) became a full owner under Section 14(1) after the Act came into force. The Supreme Court held that a widow's right to maintenance is a pre-existing right, and property granted in lieu of maintenance is recognition of that right, not a new grant. When a widow was in possession of such property on the Act's commencement date, Section 14(1) automatically converted her limited estate into absolute ownership, abolishing the concept of restricted estates for Hindu females. The widow in this case was in possession when the Act came into force, therefore she acquired full ownership rights over the property.
