Supreme Court of India 2021-04-06 dismissed

Sinnibai & Ors vs Hitsharan

Bench: 2 — 2

In Brief

The defendants, shop tenants, placed a tin shed, wooden platform over a drain, and business goods in a courtyard passage, obstructing the common area. The landlord sued for eviction under the Madhya Pradesh (Accommodation and Control) Act, 1961, Section 12(1)(c), alleging nuisance. The Trial Court and High Court found the defendants had created obstruction contrary to lease conditions. The Supreme Court upheld the concurrent findings, holding that unauthorized structures and placement of goods causing passage obstruction constitute nuisance. The Court dismissed the appeal and granted time until 31 March 2022 for vacation, subject to undertaking and regular rent payment.
