In Brief

This appeal concerns eight men convicted of murder for an assault in an agricultural field in Rajasthan in 1982 during a land dispute. The victim (father of the informant) died from injuries to the head and back, and others were injured. The Supreme Court found that all injuries were caused by a blunt object (lathi), not sharp weapons, and the incident was a sudden fight arising from the dispute. Applying Exception 4 to Section 300 IPC, the Court reclassified the offence from murder to culpable homicide not amounting to murder under Section 304 IPC, with a 6-year sentence. Two accused found to be juveniles were directed to be treated under the Juvenile Justice Acts."
