Sivasankar V.K vs V.K. Sivan and Others

Bench: 2 — Mohan M. Shantanagoudar

In Brief

In this civil appeal, the Supreme Court addressed the interpretation of a 1940 Will executed by late Komappan concerning the bequest of Schedule A property. The main dispute was whether the testator intended the property to be enjoyed by male children of three specified persons (Choikutty, Peravakutty, and Komappan Junior) in equal 1/3rd shares or distributed equally among all male children. The Court upheld the concurrent findings of both lower courts, holding that the testator clearly intended the Schedule A properties to be enjoyed by male children of the three named branches at 1/3rd each. The appeals were dismissed.
