Small Industries Development Bank of India (SIDBI) & Anr vs Emosons Organics Ltd. & Anr

Bench: 2 — Kurian

In Brief

SIDBI sought to enforce its security interest against Emosons Organics Ltd. in Jammu and Kashmir under the SARFAESI Act. The High Court questioned whether SARFAESI applied in that State. The Supreme Court, citing its precedent in State Bank of India v. Santosh Gupta, confirmed that SARFAESI is fully applicable in Jammu and Kashmir. The Court set aside the High Court's judgment and allowed the appeal, permitting SIDBI to proceed under SARFAESI according to law.
